Welcome to Aria Studio. By accessing or using our AI-powered development platform at ariastudio.co.in ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Service.

User Eligibility: Our Service is available to users of all ages. Users under 13 years of age should use our Service with parental guidance and consent.

We reserve the right to modify these Terms at any time. We will notify you of material changes via email or through the Service. Your continued use after changes constitutes acceptance of the updated Terms.

2. Description of Service

Aria Studio provides an AI-powered, browser-based development environment that enables users to:

• Generate code using natural language AI interactions
• Edit code with a full-featured code editor
• Preview applications in real-time using advanced browser technology
• Integrate with GitHub, GitLab, and other third-party services
• Deploy applications to Netlify, Vercel, and GitHub Pages
• Collaborate with team members (Teams plan)

Service Availability: We strive for high uptime but do not guarantee uninterrupted access. The Service may be temporarily unavailable for maintenance, updates, or unforeseen technical issues.

Beta Features: Some features may be in beta testing. Beta features are provided "as is" without warranties and may be modified or discontinued without notice.

3. User Accounts

3.1 Account Creation

To use certain features, you must create an account. You agree to:

• Provide accurate, current, and complete information
• Maintain and promptly update your account information
• Not create accounts using false or misleading information
• Not create more than one personal account

3.2 Account Security

You are responsible for:

• Maintaining the confidentiality of your password and API keys
• All activities that occur under your account
• Notifying us immediately of any unauthorized access

3.3 Account Suspension and Termination

We reserve the right to suspend or terminate your account if:

• Your account remains inactive for an extended period

4. Subscription and Billing

4.1 Subscription Plans

4.2 Payment and Billing

• Payments are processed securely by third-party payment processors
• Subscriptions renew automatically on a monthly basis
• You authorize us to charge your payment method for recurring fees
• Prices are in Indian Rupees (INR) unless otherwise stated
• We may change pricing with 30 days' notice to existing subscribers

4.3 No Refunds

4.4 Cancellation

You may cancel your subscription at any time through your account settings. Cancellation will:

• Take effect at the end of your current billing period
• Prevent future charges
• Allow access to paid features until the end of the billing period
• Not result in any refund for the current billing period

4.5 Token Usage

Token limits are monthly allocations that reset at the beginning of each billing period. Unused tokens do not roll over. If you exceed your token limit, AI features may be restricted until your next billing period or you upgrade your plan.

5. Acceptable Use Policy

You agree NOT to use the Service to:

• Illegal Activities: Violate any laws, regulations, or third-party rights
• Malicious Code: Create, deploy, or distribute malware, viruses, or harmful code
• AI Abuse: Attempt to manipulate, reverse engineer, or exploit AI models
• Unauthorized Access: Access or attempt to access other users' accounts or data
• Spam/Phishing: Send unsolicited communications or deceptive content
• IP Violations: Infringe upon copyrights, trademarks, or intellectual property
• Resource Abuse: Excessively consume system resources or disrupt service
• Prohibited Content: Create or share content that is illegal, harmful, or violates our policies

Violations may result in immediate account suspension or termination without refund.

6. Intellectual Property

6.1 Your Content

• You retain all ownership rights to the code and content you create
• You grant us a limited license to store, process, and display your content solely to provide the Service
• You are responsible for ensuring your content does not infringe third-party rights
• You represent that you have all necessary rights to the content you upload

6.2 Our Service

• Aria Studio and its original content, features, and functionality are owned by us
• Our trademarks, logos, and brand elements may not be used without permission
• The Service includes open-source components governed by their respective licenses
• You may not copy, modify, or reverse engineer our platform

Our Service integrates with third-party platforms (GitHub, GitLab, Netlify, Vercel, etc.). Your use of these integrations is subject to:

• The third party's own terms of service and privacy policies
• Your own API keys and credentials
• We are not responsible for third-party service availability or issues
• You are responsible for compliance with third-party terms

9. Data Export and Portability

• You can export your projects as ZIP files at any time
• Upon account deletion, you have 90 days to export your data
• After 90 days, your data will be permanently deleted
• We provide data in standard formats (code files, JSON)

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES
• WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY
• WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES
• OUR TOTAL LIABILITY SHALL NOT EXCEED THE FEES YOU PAID IN THE PAST 12 MONTHS
• WE ARE NOT LIABLE FOR SERVICE INTERRUPTIONS, DATA LOSS, OR SECURITY BREACHES
• FORCE MAJEURE EVENTS EXCUSE PERFORMANCE OBLIGATIONS

11. Indemnification

You agree to indemnify, defend, and hold harmless Aria Studio and its affiliates from any claims, damages, losses, or expenses (including legal fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of third-party rights
• Content you create or upload
• Your breach of security or access controls

12. Dispute Resolution

12.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of India, without regard to conflict of law principles.

12.2 Arbitration

Any disputes shall be resolved through binding arbitration in accordance with Indian Arbitration and Conciliation Act, 1996.

12.3 Jurisdiction

Subject to arbitration, the courts of India shall have exclusive jurisdiction.

13. Termination

13.1 User Termination

You may cancel your subscription at any time through account settings. Cancellation is effective at the end of the current billing period with no refunds.

13.2 Our Right to Terminate

We may suspend or terminate your account immediately for:

• Violations of these Terms of Service
• Illegal activities or prohibited conduct
• Non-payment of fees
• Legal or regulatory requirements

13.3 Effect of Termination

• Immediate loss of access to the Service
• No refunds for unused portions of subscriptions
• 90-day period to export data before permanent deletion
• Survival of sections regarding liability, indemnification, and disputes

14. Miscellaneous

• Entire Agreement: These Terms constitute the entire agreement between you and Aria Studio
• Severability: If any provision is found invalid, remaining provisions remain in effect
• Waiver: Failure to enforce a right does not waive that right
• Assignment: You may not assign these Terms; we may assign to affiliates or successors
• Notices: Official communications will be sent to your registered email
